1. Purpose and Legal Information
The General Terms and Conditions provided in this legal notice regulate the use of all the services and contents that the SPANISH INSTITUTE OF FOREIGN TRADE - ICEX (hereinafter, ICEX) provides users through the Web Site www.interiorsfromspain.com – hereinafter "the Site".
ICEX, with VAT Number Q2891001F, is a public body affiliated to the Spanish Ministry of Trade, Industry and Tourism, through the Secretary of State for Trade and Tourism, created and regulated by Royal Decree-Act 6/1982, of the 2nd April, and with registered address at P° de la Castellana 14-16-18, 28046 Madrid (Spain).
In order to use this Site, Users must fully and unreservedly accept these General Terms and Conditions, which may be modified by ICEX at any time. Consequently, Users must read these General Terms and Conditions every time they wish to use the Site.
The use of certain services offered to users through this Site is regulated by specific terms and conditions which may replace, complete and/or modify these General Terms and Conditions. The User must read and accept the specific terms and conditions when accessing and using these services.
2. Conditions governing access and use of the Site
The Services offered by ICEX through the Site are, unless otherwise indicated, free of charge. However, some of the services provided by third parties through the Site may be subject to payment, in which case the conditions governing the use of products/services provided by said third parties would apply.
In general, Users are not required to subscribe to or register with the Site in order to access the Services provided therein, although in order to access certain services they might have to register beforehand.
Users guarantee the truthfulness and authenticity of the information provided when subscribing to any services that require User Registration and are also obliged to ensure that this information is kept up to date.
Users agree to use the Contents and Services provided through this Site in accordance with these General Terms and Conditions and any Specific Terms and Conditions defined for specific Services, whilst at the same time complying at all times with the Law and the principles of morality and decency, and public order.
Users agree to respect the intellectual and industrial property rights of ICEX and or third parties, and to this effect will refrain from reproducing, copying, distributing, making public, transforming or modifying the Contents, without the prior consent of the holder of the corresponding rights or unless the action taken is permitted by law.
Users may not use the information obtained from this Site to create electronic, advertising, promotional or commercial communications without the prior consent of those affected.
Users wishing to establish a hyperlink between their own webpage and this Site must meet the following requirements:
a. It must not cause confusion to other potential Users with respect to the procedure and property of each of the web pages; hence the hyperlink may only direct users to the Site homepage and frames may not be created to the web pages contained in the Site.
b. The web page on which the hyperlink is established must not contain information or content which is false, inexact, illicit, illegal or contrary to the principles of morality and decency or public order and will similarly contain no content that infringes the rights of third parties,
c. The establishment of a hyperlink does not indicate under any circumstances the existence of a relationship between the Site and the owner of the website on which the link is established, nor does it imply that the Site accepts or approves of the contents or services of said website; therefore it must never be stated or implied that the Site has authorised the link or that it has supervised or accepted the services available on the website on which the link is established.
3. Exclusion of Guarantees and Liabilities
3.1. For the operation of the Site
ICEX does not guarantee the availability or continuity of the operation of the Site, its services or contents; therefore, under no circumstances can ICEX be held responsible for any damage or harm of any kind resulting from the lack of availability or continuity of the Site or any of its services, or for any errors accessing the various web pages contained in the Site or those providing certain services.
3.2. For the contents and services provided by the Site
ICEX does not guarantee the use of the Site for any particular activity or the suitability of its contents or services for specific purposes; therefore any use made of the information, contents and services contained therein will be the sole and exclusive responsibility of the User.
The Site provides the contents included in The Site in good faith with information originating from internal sources as well as external ones. Because of these circumstances and the large amount of information made available to the User through the Site, the Site cannot guarantee the absolute reliability, legality, accuracy or exactness of this information at any given time, even though every effort is made to do so.
ICEX cannot be held responsible under any circumstances, either directly or indirectly, for any content, information, messages, opinions or statements of any kind that are conveyed, broadcast, transmitted or exhibited through this Site, which stem from external sources.
The Site provides Users with technical link connection devices (such as links, banners, directories, etc.) that allow Users to access web pages or sites belonging to and/or managed by third parties of which ICEX is neither the owner nor does it have any kind of relationship with them. As a result, ICEX is not responsible for controlling or monitoring said contents and therefore will assume absolutely no responsibility, direct or indirect, for said web pages or websites. Users should exercise extreme caution when ascertaining the value and utility of the information, contents and services available through these links.
3.3 For the use made of the Site by Users
ICEX cannot control the use made by Users of the Site, its services or contents, and therefore cannot be held responsible for any harm or damage of any kind resulting from the illegal, incorrect, inappropriate or inadequate use that the Users might make of the Site, its services or contents.
Furthermore, ICEX does not guarantee privacy or security in the use of the Site and in particular does not guarantee that unauthorised third parties will not have knowledge of the kind, conditions, characteristics and circumstances of the use that Users make of the Site; therefore, ICEX cannot be held responsible for any harm or damage of any kind resulting from said unauthorised access.
4. Intellectual and Industrial Property
All Contents, understood to be - but not limited to - the texts, pictures, illustrations, graphics, software, databases, graphic designs, source code, audio-visual content and sounds, as well as the names, logos and brands accessible through the Site are subject to Intellectual and Industrial Property Rights held by ICEX or other third parties.
Any access by Users to the contents and services contained within the Site does not imply, in any case, the repudiation, transfer or assignment of any of the aforementioned rights, nor does it give Users the right to use, alter, exploit, reproduce, distribute or publicly disseminate material relating to any contents or distinct symbols that are intellectual or industrial property, without the previous and express authorisation of ICEX or the third party holder of the rights.
The User has the sole right to view and make copies of the Content for the exclusive and personal use of the User, and should exercise these rights in accordance with the principles of good faith and any applicable legislation.
5. Protection of Personal Information
In accordance with the Spanish Personal Data Protection Act 15/1999, ICEX informs Users of its personal data protection policy, so that Users may freely and voluntarily decide if they wish to provide the personal information required in order to subscribe or register for any of the services provided. Unless otherwise indicated, responses to questions of a personal nature are voluntary.
5.1 Confidentiality in the digital treatment of Users’ personal information.
Any personal information collected will be treated in a secret and confidential manner.
ICEX will implement any security measures required for the protection of personal information so as to avoid the loss, misuse, alteration, unauthorised access and theft of the personal details provided. However, Users must be aware that Internet security measures are not infallible.
5.2 Purpose of compiling and digitally treating personal information.
Any personal information collected and compiled will be treated digitally and included in computerised files which belong to and are the responsibility of ICEX.
The purpose of collecting, compiling and treating the personal information requested is to manage, administer and provide the services offered by ICEX through the Site at all times. Furthermore, quantitative and qualitative studies are conducted of the Users’ visits to the Site and use of the services therein for the purposes of designing new services related with the services provided by ICEX along with any updates, as well as sending out - by traditional and electronic means - any technical, operational and/or commercial or advertising material about the products offered by ICEX or third parties.
Under no circumstances will ICEX utilise the personal information provided by Users for any purposes other than those mentioned in the paragraph above, without firstly advising the User of its intention to do so.
ICEX may send out commercial communications in reference to similar products or services to those initially requested by the User, without the need for the User’s authorisation or express request. However, all Users have access to the relevant means to express their opposition to receiving these types of commercial communications.
5.3. Passing on Users’ personal information to third parties
Users’ personal information will not be passed onto third parties without the prior authorisation of the Users affected. In this case, ICEX will inform the User of its intention to pass on his or her personal details to third parties, indicating the identity of said party and the purpose of passing on such personal information.
5.4. Users’ consent for the treatment of their personal information and their Rights in this respect.
Users agree that any personal details provided by them may be subject to digital/computerised treatment in automated files that belong to and are the responsibility of ICEX.
The user’s consent for his/her personal details to be treated or passed on is irrevocable but cannot be backdated.
Users have acknowledged rights and may exercise these rights to access, rectify, cancel or oppose the treatment, use and passing on of their personal details by sending a letter or e-mail to the following address:

5.5. Use of cookies and activity files
ICEX might use cookies when a USER browses the sites or pages within this Site. Cookies are files sent to a browser through a web server in order to record the activities of the USER on the Site.
When users browse around the Site, their computer might receive cookies sent from the ICEX server or, on our behalf, from the servers of third party companies with which we have signed agreements regarding the provision of advertising or audience ratings services. Under no circumstances will the companies from which these cookies are sent have any knowledge about the Users’ personal details.
Cookies enable the server where the Site is held to recognise the computer used by the User with a view to making browsing simpler. They also enable any Users that have registered with the Site to access the exclusive content for registered Users contained within the Site without having to register every time.

6. Procedures in the case of illegal activity in the use of services
If any Users or third parties become aware of events or circumstances that reveal illegal usage of any Content or illegal activity on the websites included or accessible through the Site, and in particular, the violation of intellectual and industrial property rights or other rights, ICEX should be advised of the following:
a. claimant's personal information: name, address, telephone number and e-mail address;
b. specification of the alleged illegal activity carried out on the Site, and particularly when it pertains to an alleged violation of rights; precise and specific indication of the protected contents and their location on the web pages;
c. events or circumstances that reveal the illegal nature of said activity;
d. in the event of an alleged violation of rights, a handwritten signature or equivalent, with the personal information of the holder of the rights supposedly infringed or the person authorised to act on behalf of this person;
e. express and clear declaration, under the responsibility of the claimant, that the information provided is accurate and that the use made of contents in the activity described is illegal in nature.
7. Notifications
Any notifications and communications (hereinafter "Notifications") made by Users to ICEX will be considered effective, for all intents and purposes, when they are made by one of the following means:

8. Withdrawal and suspension of services
ICEX may withdraw or suspend at any time and without prior warning the provision of Services to any Users who fail to comply with the present General Terms and Conditions or any Specific Terms and Conditions established for a certain Service.
9. Duration and termination
Unless stated otherwise, the provision of this Site service and the other Services offered therein has an indefinite duration. However, ICEX is authorised to terminate or suspend the provision of the Site service and/or any of the other Services offered therein at any time, notwithstanding any stipulations provided in the corresponding Specific Terms and Conditions. When it is reasonably possible, ICEX will give prior warning about the termination or suspension of the provision of this Site service and the other Services offered therein.
10. Applicable Law and Jurisdiction
These General Terms and Conditions are governed by Spanish Law.
For any disputes that may arise from the application of these services or from the interpretation or application of the General Terms and Conditions, ICEX and the User expressly relinquish their own jurisdiction and submit themselves to the jurisdiction of the Courts and Tribunals of Madrid.
